Abstract

This volume addresses the growing trend among EU Member States of entrusting the resolution of family and succession matters to bodies other than judges, such as notaries, civil status officers, public authorities, and lawyers. This de-judicialisation challenges the current EU private international law framework, which largely assumes judicial involvement. Through a comparative analysis conducted within the framework of the 'Extra-Judicial Administration of Justice in Cross-Border Family and Succession Matters' Project of the European Law Institute, the present volume explores whether the EU instruments on jurisdiction, applicable law, recognition and enforcement in family and succession matters are fit for this evolving landscape. The Project identifies critical issues and best practices and formulates principles and policy recommendations to guide future reforms.
